Please read these Terms of Service ("Terms") carefully before using the GemmaAI.space website ("Service") operated by GemmaAI ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Service.

1. Description of Service

GemmaAI provides an AI-powered email assistant for import and export trade teams, built on the Gemma 4 open-source language model. The Service is currently in a pre-launch phase. By joining our waitlist, you are registering interest in accessing the Service when it becomes available. No active product functionality is provided at this time beyond the waitlist registration.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate. Use of the Service for personal, commercial, or enterprise purposes is permitted subject to these Terms.

3. Waitlist Registration

When you submit your email address to join the waitlist, you agree to receive email communications from GemmaAI related to the product launch and updates. Joining the waitlist does not guarantee access to the Service, does not create a contract for service provision, and does not entitle you to any specific features, pricing, or availability date. You may unsubscribe at any time by emailing hello@gemmaai.space.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Transmit spam, unsolicited emails, or deceptive communications.
• Attempt to gain unauthorized access to our systems or infrastructure.
• Scrape, crawl, or harvest data from the Service in an automated manner without our prior written consent.
• Impersonate GemmaAI, our team, or any other person or entity.
• Interfere with or disrupt the integrity or performance of the Service.

5. Intellectual Property

All content on this website — including text, images, the GemmaAI name, logo, and design — is owned by or licensed to GemmaAI. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

The Gemma 4 model is developed and owned by Google DeepMind and is licensed under the Apache 2.0 License. GemmaAI's use of Gemma 4 is subject to Google's terms. GemmaAI is an independent product and is not affiliated with, endorsed by, or sponsored by Google.

6. AI-Generated Content

When the Service becomes active, it will generate text using AI models including Gemma 4. AI-generated content may contain errors, inaccuracies, or outputs that are not suitable for direct use in commercial communications. You are solely responsible for reviewing, editing, and approving any AI-generated content before sending it to third parties. GemmaAI does not guarantee the accuracy, completeness, or commercial suitability of any AI-generated output.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, GemmaAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of business opportunity, or damage to goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim, or USD 100 if no payment has been made.

9. Indemnification

You agree to indemnify and hold harmless GemmaAI and its team members from any claim, liability, damage, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
